Welcome to Bird Book. Bird Book is operated by Arthur De Araujo in Washington, United States ("Bird Book," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your use of the Bird Book mobile application, the birdbook.io website, and the products and services offered through them (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

01Who may use Bird Book

You must be at least 13 years old (or the minimum age required in your country to use an online service without parental consent) to use Bird Book. By using the Service you confirm that you meet this requirement.

02Your account

You sign in to Bird Book with your Apple or Google account. You are responsible for the activity that happens under your Bird Book account and for keeping your sign-in method secure. Provide accurate information, and let us know right away if you believe your account has been compromised.

03Bird Book Pro subscriptions

  • Plans. Bird Book Pro is offered as an auto-renewing monthly or yearly subscription, purchased through Apple's App Store. The price is shown in the app before you subscribe.
  • Free trial. Where offered, a free trial converts to a paid subscription at the end of the trial period unless you cancel at least 24 hours before it ends.
  • Auto-renewal. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Payment is charged to your Apple ID. You can manage or cancel your subscription at any time in your device's App Store subscription settings — deleting the app does not cancel a subscription.
  • Refunds. Purchases made through the App Store are subject to Apple's refund policies; refund requests are handled by Apple.
  • Founding Member. The Founding Member badge is offered to a limited number of early yearly subscribers. It is a cosmetic recognition, is granted once per account, and remains on the account permanently.
  • Free tier. Features available without a subscription (for example, gallery and post photo limits, and daily Bird Outlook access) are limited and may change over time.

04Photo books and other physical products

  • Printing and delivery. Printed photo books are produced and shipped by a third-party print partner. Prices, formats, and estimated delivery times are shown at checkout.
  • Your approval. The preview you approve at checkout is what gets printed. Please review it carefully — we cannot change a book after it has gone to print.
  • Print quality. Print sharpness depends on the resolution of your photos. The app warns you when a photo may print softly; ordering with such photos is at your discretion.
  • Problems with an order. If your book arrives damaged or with a manufacturing defect, contact us at [email protected] and we will make it right with a reprint or refund. Because every book is custom-made from your photos, we cannot accept returns for reasons other than damage or defect, except where applicable law gives you a non-waivable right to another remedy.

05Your content

You keep ownership of the photos, posts, comments, and other content you share on Bird Book. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that content solely to operate and improve the Service — for example, showing your posts to the audience you chose, rendering your photo book, or generating a share preview.

You are responsible for the content you post. Only post content you created or have the right to share.

06Community rules

Bird Book is a place to share birding, not to harm others. You agree not to post content that is unlawful, harassing, hateful, pornographic, deceptive, infringing, or otherwise objectionable, and not to spam, impersonate others, scrape the Service, or interfere with its operation.

We provide tools to report content and block users. We review reports and may remove content, restrict features, or suspend or terminate accounts that violate these rules — with or without notice, at our discretion.

07Outdoors, wildlife, and location

  • Birding happens outdoors. You are responsible for your own safety during trips and day outings; use good judgment about terrain, weather, and wildlife.
  • Bird identification, weather information, birding tips, and the daily Bird Outlook are provided on a best-effort basis for enjoyment. They are not professional, scientific, or safety advice.
  • Recording a trip stores the route you walked. You control whether a post's map is visible, and you can hide it after posting. Be thoughtful about sharing locations — of sensitive nesting sites, and of yourself.

08Bird Book's property

The Service — including the app, website, design, logos, and the Bird Book name — is our property or that of our licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable license to use the app for its intended purpose. You may not copy, modify, or reverse-engineer the Service except where the law permits.

09Ending your use

You may stop using Bird Book and delete your account at any time from the app's settings. We may suspend or terminate your access if you breach these Terms or where we must do so by law. Sections that by their nature should survive (such as content licenses for content you have chosen to leave public, disclaimers, and liability limits) survive termination.

10Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not promise the Service will be uninterrupted, error-free, or that any content (including species identification and weather data) is accurate.

11Limitation of liability

To the fullest extent permitted by law, Bird Book will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim and US $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12Changes to these Terms

We may update these Terms as Bird Book evolves. If a change is material, we will give you reasonable notice — for example, in the app or by email — before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.

13Governing law

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. To the extent the law permits, disputes will be resolved in the state or federal courts located in Washington, and you consent to their jurisdiction. Nothing in these Terms takes away consumer protections or other rights that the law where you live does not allow you to waive.
